6 Benefits of Arbitration (Pt. 2)

Picking up from where 6 Benefits of Arbitration (Pt. 1) left off, here, we will point out some more notable advantages to proceeding through arbitration, as opposed to traditional litigation, to resolve legal disputes.

In most cases, the decisions rendered from arbitration proceedings are final and legally binding, making them difficult to appeal. While the decisions handed down from traditional litigation are also final, those developed in other dispute resolution proceedings – like, for instance, mediation – may not be final, which could end up (again) increasing the time and costs necessary to bring disputes to resolutions.

4 – The impartiality of the process

Depending on the nature of a dispute (as well as where that dispute is being resolved), arbitrators may end up being selected:

  • Directly by the disputing parties
  • Through a process that involves the input or preferences of both of the disputing parties
  • An impartial third party.

What this means is that arbitration generally has the impartial setting that can be provided in a courtroom setting (without some of the hassle, expense and complications that come with the traditional litigation process).

5 – The confidentiality of the process

With traditional litigation, the proceedings typically occur in open hearings, the statements made during these hearings are recorded by the court reporter, and the details of the case are usually a matter of public record. In the event that the nature of a dispute (or evidence related to it) is confidential, proceeding through arbitration can be an effective way to maintain the confidentiality of the proceedings, as well as the outcomes of them.
